ART review fees rose on 1 July 2026, and the trigger is the date the fee is paid
The fee to review a migration decision is now $3,727 and a protection decision $2,293, and the new fees apply to any fee paid on or after 1 July 2026 even where the application was lodged before that date.
The Tribunal’s published fees from 1 July 2026 are $3,727 to review a reviewable migration decision and $2,293 to review a reviewable protection decision, with the standard application fee and the Guidance and Appeals Panel fee at $1,195. Fees are indexed to the Consumer Price Index and notified in the Government Notices Gazette.
The timing rule is the part that catches people. The Tribunal states that the new fees apply to any application fee paid on or after 1 July 2026, even if the application was lodged prior to that date
. Lodgement date does not fix the fee; payment date does.
A 50 per cent reduction of the migration review fee may be granted on financial hardship grounds. The protection review fee is generally payable only if the review is unsuccessful.
Separately, the Tribunal replaced six of its practice directions with effect from 2 March 2026, including the Migration, Protection and Character Practice Direction, and published a new Practice Direction on the use of generative artificial intelligence in Tribunal proceedings in August 2026.
