What does the partner visa checker do?

It sorts your answers into one of three pathways: the subclass 820/801 applied for in Australia, the subclass 309/100 applied for outside Australia, or the subclass 300 Prospective Marriage visa. It then lists the issues your answers raise, each linked to the part of our partner visa guide that explains it.

Does the checker decide whether I am eligible?

No. It shows which pathway to look at and what to check. Whether a visa is granted turns on things a list of questions cannot see: the evidence of the relationship, health and character, the sponsor’s history and the applicant’s full visa history. Those are assessed in a consultation.

What happens to my answers?

They stay in your browser unless you choose to send them. The checker runs on this page and stores nothing. If you fill in the contact form under your result, your answers, the result and your contact details are emailed to us so we can contact you; nothing is sent to anyone else. Our privacy policy explains how we handle what you send.

Which issues does the checker look for?

The 12-month rule for de facto couples, the age rule for de facto partners, a No Further Stay condition, section 48, Schedule 3, the three-year rule for subclass 491 and 494 holders, a previous partner visa refusal, and the limits on sponsoring a partner.

It does not look at health, character, the evidence of your relationship, or whether a sponsor’s criminal record affects the sponsorship. Our guide covers sponsorship and relationship evidence.

Why does it matter where the applicant is when we apply?

The partner visas are divided by where the applicant is when the application is made. The 820/801 is applied for in Australia; the 309/100 and the subclass 300 are applied for outside Australia. Applying in Australia also brings in rules about the visa the applicant holds at that moment, which is why the checker has more questions for an applicant who is here.
