The Migration (LIN 19/215: Sponsorship Applications and Nominations for Subclass 407, 457, 482 and 494 Visas) Instrument 2019 (LIN 19/215) was signed on 8 November 2019 by the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs under provisions of regulations 2.61, 2.66, 2.73, 2.73A and 2.73B of the Migration Regulations 1994 (section 3). It commenced on 16 November 2019, at the same time as Schedule 2 to the Migration Amendment (New Skilled Regional Visas) Regulations 2019 (section 2). It repealed IMMI 18/038 (Schedule 1) and has not been amended.

The explanatory statement states that it gives effect to new subregulations 2.73B(4), (5), (7) and (14) by specifying the forms and fees for sponsorship applications and nominations under the new Subclass 494 visa, and that the fees were calculated on a cost recovery basis.

Manual lodgement when online systems fail

Section 7 allows a sponsorship application or nomination to be emailed instead of lodged online where a departmental email authorises it after the Department has identified a problem with its Internet application systems. Under section 7(3), the problem must be one that cannot be rectified, or one unlikely to be rectified that day where an affected visa applicant would become an unlawful non-citizen by the next business day. The departmental email must come from the address in the section 7(6) table, attach the approved form and name the sender and position number.

The completed form must be emailed back to the sending address by the end of that day, by legal time in the Australian Capital Territory, with a copy of the departmental email (section 7(4)). The section 7(6) table names e482.Manual.Lodgement@homeaffairs.gov.au for standard business sponsorship (482S) and subclass 482 nominations (482N), and e494.Manual.Lodgement@homeaffairs.gov.au for subclass 494 nominations (494N). The note to section 7(6) states that the section 6 fee applies to a manual lodgement. Section 8 makes similar provision for subclass 407 training nominations, which may also be made at an Australian diplomatic, consular or migration office by an applicant outside Australia (section 8(8)).
