eVisitor form, ADS travel agents, health-referral countries and ESOS agencies remade

eVisitor applications

The Migration (Arrangements for eVisitor Visa Applications) Instrument 2026 (LIN 26/061) specifies Form 1362 (Internet) as the approved form for a Subclass 651 eVisitor application and requires the application to be made as an internet application. It repeals the 2016 arrangements instrument.

Approved Destination Status travel agents

The Migration (Arrangements for Visitor (Class FA) visa applications) Amendment Instrument 2026 (LIN 26/060) repeals and substitutes the table of travel agents in the 2021 instrument (LIN 21/056). The new table lists 78 travel agents, with a code and province or municipality for each.

Countries for health referrals

Regulation 2.25A requires the Minister to seek a Medical Officer of the Commonwealth’s opinion on the health criteria unless an exception applies. One exception is a permanent visa application made from a specified country where nothing is known suggesting the requirements may not be met. The Migration (Health Criteria–Specified Countries) Instrument 2026 (LIN 26/090) lists 237 countries, Australia included, and repeals LIN 23/071. It applies to applications made on or after commencement and to those made but not finally determined before it.

ESOS agency for ELICOS and Foundation Programs

The Education Services for Overseas Students (ESOS Agency – ELICOS and Foundation Programs) Determination 2026 replaces the 2016 determination. For ELICOS, the agency is TEQSA for a registered higher education provider, the National VET Regulator for a registered VET provider, the Secretary for an approved school provider, and TEQSA for any other provider delivering ELICOS under an entry arrangement with a higher education provider; otherwise the National VET Regulator. For Foundation Programs it is TEQSA.
